1) EzyHolidayRentals.com (EA Sales) reserves the right to amend remove or replace any or all of the following terms & conditions at any time without further notice.
Content of Advertisements
1) All advertisements placed on this website should comply with all relevant UK legislation including the Trade Descriptions Act 1968 (which covers false descriptions) and the Consumer Protection Act 1987 (which covers misleading prices). The advertiser agrees to indemnify EzyHolidayRentals.com (EA Sales) against all claims and costs arising out of any misleading information in the advertisement.
2) EzyHolidayRentals.com (EA Sales) accepts advertisements in all good faith and expects that advertisers will provide an accurate description of their property.
3) EzyHolidayRentals.com (EA Sales) will take every care to reproduce faithfully the text, prices, contact details and photographs when provided to us by advertisers. We can not and will not be held liable for any loss arising out of any errors or omissions on our part.
4) EzyHolidayRentals.com (EA Sales) reserves the right to determine the design and layout of all advertisements, and (at our discretion) to make alterations to any submitted text or photographs should we consider any to be necessary. EzyHolidayRentals.com (EA Sales) can not and will not be held liable for any loss arising out of any such alterations.
Materials and Photographs
1) EzyHolidayRentals.com (EA Sales) will take the utmost care of all materials and photographs provided for the preparation of advertisements, but can not and will not be held liable for any loss or damage howsoever caused.
Copyright
1) It is the responsibility of all advertisers to ensure that they have the right to reproduce any photographs or digital images which they supply to us. The advertiser agrees to indemnify EzyHolidayRentals.com (EA Sales) against all claims and costs arising out of any infringement of copyright for such photographs or images.
2) All digital images produced by EzyHolidayRentals.com (EA Sales) from any photographs or media supplied by advertisers are the property of EzyHolidayRentals.com (EA Sales) and shall not be reproduced without our express written permission.
Liability
1) EzyHolidayRentals.com (EA Sales) can not and will not be held liable for any loss or damages howsoever incurred including any consequential losses such as lost income in connection with advertising on the EzyHolidayRentals.com (EA Sales) website.
Linking to Personal Websites
1) EzyHolidayRentals.com (EA Sales) may (at our sole discretion) include one link per advertisement to a personal website. The personal website must relate only to the property advertised on our website and we reserve the right to refuse any such links or to remove them without notice.
Exchanging Properties
1) Each advertisement shall relate to a particular property which will be issued with a unique reference number (PID) and it is not allowable to substitute a different property by changing the text and photographs on any advertisement.
Refusal, Termination or Withdrawal of Advertising
1) EzyHolidayRentals.com (EA Sales) reserves the absolute right to refuse to accept any advertisement that is submitted. If the advertisement has been paid for on-line a full refund will be made and if a cheque has been received by post it will be returned. Any materials submitted by post will also be returned. Under no circumstances will any compensation be payable by EzyHolidayRentals.com (EA Sales) for any loss howsoever incurred, including loss of income, the time/cost involved in submitting the advertisement etc.
2) If EzyHolidayRentals.com (EA Sales) should receive any complaints about a property we reserve the right to remove that property from our website without notice if in our opinion the complaint is reasonably substantiated. Such complaints could relate to the accuracy of an advertisement the condition or the maintenance of the said property unacceptable booking conditions or procedures lack of adequate response to complaints etc. In all cases our decision shall be final. A refund will normally be made on a pro-rata basis for the remaining unused period of the advertisement however under no circumstances shall any compensation be payable by EzyHolidayRentals.com (EA Sales) for any losses howsoever incurred including loss of income re-advertising costs etc.
3) The advertiser may choose to deactivate their advertisement from being shown on the EzyHolidayRentals.com (EA Sales) website at any time without refund by using their personal control panel. The advertiser may also ractivate their advertisement by the same method at any time during the period of advertising purchased. Please note that the period of advertising will not be extended to allow for any time when the advertisement was deactivated and not showing on the website.
Email Enquiry Forms
1) Email enquiry forms are provided on each advertisement for the sole use of holidaymakers making a genuine availability and booking enquiry. EzyHolidayRentals.com (EA Sales) constantly monitors the use of these forms and will suppress any such emails which are not genuine availability or booking enquiries or which constitute unsolicited commercial marketing.
Level of Service
1) EzyHolidayRentals.com (EA Sales) will endeavour to approve new advertisements, and approve changes to existing advertisements as quickly as possible but as we have no control over the number of requests that may be received at any one time we are unable to guarantee response times.
2) As we run our property advertisement service from our own secure servers located in Texas EzyHolidayRentals.com (EA Sales) will endeavour as far as practical to ensure that the website is available on the internet at all times. However some breaks in service are inevitable and often beyond our control, we are therefore unable to guarantee a 100% availability. |
